Terms of Service

Unspokio is provided by Ezequiel de Jesús Martínez de Escobar Martínez de la Cueva ("Unspokio", "we"). Unspokio is a software-as-a-service application that analyses conversations you submit and returns indicative signals about manipulation, pressure, deception and similar communication patterns, together with reports and history tools.

You must be at least 16 years old and, if you accept these terms for an organisation, you confirm you have authority to bind it. You must provide accurate registration details, keep them up to date, keep your credentials confidential, and you are responsible for all activity under your account.

We grant you a limited, non-exclusive, non-transferable, revocable right to use Unspokio within the plan you have selected. You may not resell, sublicense or redistribute the service, reverse engineer or copy it, circumvent usage limits or technical protections, or use it to build a competing product.

You must not use Unspokio unlawfully; commit fraud, spam or harassment; infringe intellectual property or privacy rights; upload malware; probe, scan or interfere with our security or infrastructure; scrape the service; or submit content you have no right to submit. You must not use Unspokio to surveil, stalk, coerce or discriminate against any person, nor as the sole basis for decisions with legal, employment, financial or medical consequences.

You keep all rights in the conversations and files you upload. You grant us a limited licence to host, process and transmit that content strictly to provide the service to you, including sending it to our AI provider to generate your analysis. You are responsible for having the necessary rights and permissions for everything you submit.

Analyses are produced by automated language models and may be incomplete, inaccurate or otherwise wrong. They are informational only and are not legal, psychological, medical, financial or investigative advice, and are not a diagnosis. You are responsible for verifying outputs and for how you use them, and you should apply human judgement before acting. We may moderate, filter or refuse content and outputs, and we may act on rights-holder takedown requests sent to us; repeated infringement can lead to termination.

Paid plans are billed monthly or annually in advance and renew automatically until cancelled. Payments are processed by Stripe on our behalf; we remain the seller of record for your subscription. Applicable sales tax, VAT or IVA is calculated and collected at checkout and shown before you confirm. Payment, billing, cancellation and refund mechanics are governed by these Terms and by our Refund Policy.

Free accounts include a limited number of analyses. We may adjust plan features, limits and prices; where changes affect a paid plan we will give reasonable notice before they apply to your next renewal.

We and our licensors own Unspokio and all rights in its software, models, prompts, documentation, design and branding. Nothing in these terms transfers ownership of the service to you.

We work to keep Unspokio available and reliable but we do not guarantee uninterrupted or error-free operation, and maintenance or outages may occur. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, including lost profits, lost data or loss of goodwill. Our total aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

You will indemnify us against claims, damages and reasonable costs arising from content you submit, your unlawful use of the service, or your breach of these terms.

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service and cancel at any time. On termination your licence ends; you may export your analyses during a reasonable window, after which we delete or anonymise your data as described in the Privacy Policy.

These terms are governed by the laws of the United Mexican States, and the competent courts of Mexico City have jurisdiction, without prejudice to consumer-protection rights available to you where you live.

You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or reorganisation. Neither party is liable for delays caused by events beyond its reasonable control. If a provision is unenforceable the remainder stays in force. Questions: support@unspokio.com.
